This contract and the rules of proper use (hereinafter referred to as the “Contract” and the “Rules”) contain important information on your participation on Photodays. You can read, save or print out any part of this Contract.
ATTENTION: IF YOU DECIDE TO ACCEPT THE TERMS OF THIS CONTRACT, YOU HAVE TO ACCEPT IT IN ITS ENTIRETY – THE ORGANIZER WILL NOT ACCEPT ANY CHANGES (ADDITIONS OR OMISSIONS).
The organizer has the right to change, add or omit at any time any part of the Contract, or any part of its services or features, including time limits. In such a case, the changes will be announced on the organizer’s internet page.
YOUR CONTINUOUS VISITS TO THE WEB PAGE AND THE PARTICIPATION ON THE PHOTODAYS NOW OR AFTER THE ANNOUNCEMENT OF ANY CHANGE WILL BE REGARDED AS ACCEPTANCE OF THE TERMS OF THE CONTRACT AND ANY SUBSEQUENT CHANGES THEREOF.
The organizer shall accept the cancellation of registration (or any other additional services) five (5) working days before the final deadline for the competition.
The organizer shall take all possible measures to ensure the availability of all indicated events, but the organizer cannot guarantee or be held responsible for interruptions or mistakes and he does not guarantee that the participants will be able to participate in all competitions and exhibitions.
The organizer encourages the participants to express their opinion on line and take advantage of this interactive experience. However, it is important to bear in mind that there are rules and standards which should be respected during participation on Photodays. These rules and standards shall be stipulated in this Contract. As a participant on Photodays, you shall accept to the provisions of this Contract and agree that the organizer has the right to implement this Contract at his own discretion. This means that in case that you or any other participant on Photodays violate the provisions of the Contract, the organizer can take any actions considered necessary or appropriate by the organizer – varying from warning about the violation of the Contract to the cancellation of your privileges or even legal actions. The organizer may or may not inform you before canceling your participation owing to the violation of rules and standards. You yourself shall be responsible for your behavior during participation on Photodays. A participant of Photodays should adhere to the law, respect the rights of other participants on Photodays and the rights of third parties. By registering on Photodays you agree to behave in an appropriate manner and to use appropriate language during your participation – this includes (but is not restricted to) respecting the rules, as well as the sponsor’s rules.
The organizer retains the right to cancel your registration on Photodays at any time, with or without reason. If the organizer decides so, the cancellation does not have to imply a refund of any pre-paid fee or any other payments (subject to relevant law).
Inappropriate behavior falls within many categories. The most common categories are listed below, however that does not represent the entire list.
If the organizer decides to cancel your right to participate on Photodays owing to illegal or forbidden behavior, the organizer shall maintain the right to cooperate with the representatives of the law, including acting according to orders, writs or subpoenas. Besides that, he shall maintain the right to act according to civil court rulings and/or subpoenas. If the organizer decides to investigate or solve possible problems which include you, he has the right, except when it is restricted by law, to disclose your particulars which he has relating to your participation on Photodays or anything else relating to Photodays to the representatives of the law or other government officials. By accepting this Contract and participating on Photodays, you authorize the organizer for such actions.
The organizer maintains the right to cancel your registration with or without prior notice. The organizer maintains the right to finally determine whether your behavior is appropriate or not.
The organizer maintains the right to supervise all features and contents of Photodays at his own discretion (subject to relevant laws).
If the organizer suspects a possible violation of the rules, he can initiate an investigation which may include the gathering of information about any member of Photodays, any third party or complaining party.
During the investigation, the organizer can suspend or cancel the participation of a participant partially or entirely and/or remove the participant from the competition. If the organizer believes at his own discretion that there has been a violation of this Contract, he can take necessary actions.
If the result of the investigation shows that there have been criminal activities, the organizer maintains the right to refer the matter to relevant legal institutions and to cooperate with them.
By registering to Photodays you agree (to the extent permitted by law) to renounce any rights of claim against the organizer or general sponsor, as well as not to hold them responsible and to compensate for the damages regarding any claims connected with any activities which the organizer has taken owing to the suspicion of the violation of the Contract or as a result of the investigation or decision that there has been a violation of the Contract. That means that you cannot sue the organizer or receive any compensation from the same, nor from the general sponsor, regarding their decision to remove you from the competition, to warn or suspend you or to take any other actions during the investigation owing to the suspicion of the violation of the Contract or actions which resulted from the conclusion that there has been a violation of the Contract. This provision on renouncement and compensating for the damages shall apply to all violations of the Contract mentioned and described in the Contract.
You shall explicitly agree to participate on Photodays at your own risk. Services, competitions, exhibitions, etc. shall be provided “as they are” or “as available” for your participation, without explicit or implied guarantees.
Photodays, managers, officials, employees, subsidiaries, agents or subcontractors shall in no way be held responsible for any direct, indirect, accidental, special or consequential damages resulting from your participation on Photodays or in any other compensation claim related in any way to your participation on Photodays.
The organizer shall not accept or guarantee for any third party products or services offers through Photodays and shall not take part or be held responsible for the supervision of transactions between yourself and a third party through Photodays. Thus you are absolving the organizer from any obligations, responsibilities or compensation claims not mentioned in the limitation of liability.
This Contract represents your entire agreement with the manifestation Photodays. You agree that this Contract does not transfer any rights or legal redress to a third party, except you as a participant.
If any part of this Contract is invalid or impossible to implement according to the law, that part shall be composed according to the law in a way that expresses the intent of the parties in the best possible manner, while the rest of the Contract shall remain valid. The Contract and your participation on Photodays are subject to Croatian laws, excluding its conflict with the rules. You explicitly agree that the court of the Republic of Croatia has jurisdiction over any compensation claims or disputes with the organizer.
